Terms and Conditions

These Terms and Conditions (this “Agreement”) govern any membership in National Roadside Service, LLC (NRS) Membership Program.  NRS is a Colorado Corporation (“we, “ “us,” “our,” “ours”).  Purchase or use of the program at any time subjects the purchaser or user (“you,” “your,” “yours,” “Members”) to the terms and conditions hereof.

Certain Membership Conditions:

1. NRS Membership is available to all qualifying individuals 18 years of age or older
2. We reserve the right to refuse NRS Membership to any applicant and NRS Membership is revocable, at any time, without cause, at our sole discretion.
3. Limit one NRS Membership per truck.  If Membership cards are lost, replacement cost is at owner’s expense.
4. For any discount or other benefit to apply, the NRS Membership account number must be active and available at the time of purchase/use.
5. NRS Membership is non-transferable.
6. We expect Members/Vendors to submit and maintain accurate user information in connection with their NRS Membership account.  Such information includes name, address, email address and telephone number.  Members/Vendors can change their account information by contacting us via the site or by mail to: NRS P.O. Box 372, Brighton, CO 80602.  We cannot assume any liability for the correspondence, mail or email, which is lost, delayed, or misdirected.
7. During a breakdown, services will not be rendered if the Member ID# is not given to the call center at time of dispatch.

Term

The initial term of NRS Membership shall commence on the date it is purchased and continue until one year from the day on which the membership was purchased, unless we terminate your NRS membership.  The initial fee will be billed to the credit card that is active in your account.  Your account is set up for automatic renewal, I understand that my credit card will automatically, every year, be charged the annual fee unless a 30-day written notice is given.

NRS Membership Cancellation

You have the right to cancel your NRS Membership at any time.  No refunds will be available at any time or in any circumstance.  All monies are non-refundable.  You can cancel your NRS Membership by calling us at 1-888-988-1677 or contacting us via the website at: www.nationalroadsideservice.com.

Program Termination:

We may terminate any or all of the benefits available to you or all Members under the NRS Membership Program at any time, without notice, at our sole discretion.  If we do terminate, it will be effective immediately.  NRS reserves the right to refuse to do business with anyone for any reason at any time.

Privacy:

As a Member, the information we capture will be subject to the NRS Privacy and Security policy as amended from time to time in accordance with its terms.  You may view this policy on the site.

Disclaimers; Limitation of Liability:

Use of NRS Membership is at your sole risk.  The NRS benefits are provided on an “As Is” and “As Available” and “As Needed” basis.  NRS, LLC, and any of its affiliates, directors, officers and agents (collectively “provider”) expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.  Provider makes no warranty that Membership will meet your requirements, NRS Membership will be uninterrupted, timely, secure, or error-free, or the quality of any products, services, information, or other material purchased or obtained by you from your use of NRS Membership will meet your expectations.  Provider shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if provider has been advised of the possibility of such damages), resulting from: the use or the inability to use NRS Membership or any benefits thereof; the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered via the use of NRS Membership; unauthorized access to or alteration of your NRS Membership data; or any other matter relating to NRS Membership.  Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages.  Accordingly, some of the above limitations may not apply to you.

Governing Law

This Agreement, and the respective rights and obligations of the parties hereunder, shall be governed by, and construed in accordance with, the laws of the State of Colorado, without regard to conflict of law principles.

Binding Arbitration:

Any controversy or claim arising out of or relating to this Agreement (including any breach thereof) or the NRS Membership Program shall be settled by arbitration.

Changes to this Agreement:

We may change the terms of this Agreement at any time, without written notice or consent.
